Mercedes-Benz Financial Services South Africa is looking for a Legal and Collection Specialist  who will ensure a high focus on brand, customer and dealer relationship management by effective and efficient communication with customers, external service providers and stakeholders to manage the attorney handover process for matters in breach and to manage the Defended and Liquidation portfolios optimally. The incumbent will be required to co-ordinate, administer and review the drafting and approval process of ProMap, Work Instructions, ISO Controls, Legal and Collections Reporting and to manage the Internal and External Audit Controls assessment, administration and implementation to ensure compliance for the Legal and Collections Department as a whole. Support the SLA renewal process for all external service providers all within prescribed timelines and in compliance to the Company's Integrity Codes.

 Main Tasks:

Build and maintain strong relationships with relevant stakeholders, i.e. Customers, External Service Providers, Attorneys, Liquidators, Mercedes-Benz South Africa employees, MBFS Management Team, Regional and HQ employees.Administer, co-ordinate and manage the Legal hand-over process of matters in breach to obtain Return of Asset orders including regular in-person engagements with key responsible attorneys, heads of the attorney’s firms and administrative staff to review, analyse and assess service delivery performance standards, per Jurisdiction in order to  identify and implement corrective measures by key decision making on process, to optimize and prioritise to ensure effective management of the outsourced portfolio.

Administer, co-ordinate and manage the Defended portfolio with the objective to resolve legal matters swiftly by in-person engagements with customers, attorneys and counsel through round table consultations with all stakeholders concerned to derive at the most suitable decision to minimise legal costs and mitigate the risk for MBFS, in a timely manner.

Administer, co-ordinate and manage the Liquidation and Sequestration portfolios optimally to secure and sell the assets swiftly, manage the payment of proceeds to liquidators in order to receive dividends in a timely manner and perform recons on this portfolio on a monthly basis to identify matters for closure, all in consultation with counsel, liquidators and customers where applicable.

Facilitation and decision making on settlement agreements for legal matters and to manage the Order of Court and Stay of Execution Agreements within the departmental guidelines and procedures to ensure compliance by customers to  the to the agreed terms, alternatively decision making on the repossession of the customer’s assets or otherwise to limit the loss position for MBFS.

Facilitate, analyse, recommend and manage the implementation of the proposed risk mitigations pertaining to Internal and External Audit controls and findings for the Legal and Collections department to ensure risk, legislative, security, process and segregation of duty compliance.

Ensure timely review of the Promap Processes, Work Instructions and ISO controls in collaboration with Legal and Collections management team and obtain relevant approvals for communication to the key stakeholders involved in changes implemented to ensure compliance with Local and Global Credit Rules, Definition catalogue, Product programmes, Procurement policies and all relevant legislative and compliance governance.

Ensure timely completion of all monthly Legal and Collections reporting to internal and external stakeholders.

Support the procurement process for on-boarding and renewal of External Service Providers for the Legal and Collections department’s collections, repossessions and towing functions.

Credit Lending principles and practices

Understanding and application of requirements pertaining to asset based finance.

Understanding and application of prevailing litigation process and Acts governing  Asset Based Finance products.

 Experience: 

  • 3 to 5 years work experience in a Financial Services Industry / Banking / Insurance environment.

  • Experience in financial legal environment with a specific focus on the National Credit Act, Financial Advisory and Intermediary Services Act, Short-Term Insurance Act, Consumer Protection Act, Protection of Personal Information Act and Financial Intelligence Centre Act.

  • NCA / FICA / FAIS would be advantageous.`

Qualification:
